scope of application

(1) The following "General Terms and Conditions" (GTC) apply in the version valid on the day of the order to all purchase contracts for services and products between the tsar Gesundheitsbildung KG Shop (tsar Shop for short) and its customers. By placing an order, the customer agrees to these GTC and is bound by them.

(2) Should individual provisions of these General Terms and Conditions be wholly or partially invalid due to mandatory statutory provisions, the remaining provisions of these General Terms and Conditions shall remain unaffected.

 

conclusion of contract

The contract is concluded upon acceptance of the order by the tsar shop, either by sending an order confirmation electronically or by post, or directly by sending the ordered goods.

 

right of withdrawal

(1) You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods. To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or email). You can use the attached sample withdrawal form for this purpose, but this is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period expires.

 

Consequences of revocation

(1) If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. The customer is responsible for the costs of returning the goods.

(2) We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

(3) There is no right of withdrawal for services that have been transmitted online (e.g., online courses and training programs, documents, vouchers), audio or video recordings such as CDs, DVDs, etc., or computer software delivered in sealed packaging if the goods have been unsealed after delivery.

Prices

(1) In principle, the purchase price agreed for the goods ordered is the price listed in the online shop and similar publications of the tar Shop. Depending on the status of the customer (member or non-member of tsar Premium), the prices listed in the price lists or in the online shop apply.

(2) Unless otherwise stated, all prices are gross prices including statutory sales tax and excluding all shipping costs.

 

terms of delivery

(1) Delivery normally takes place within 7 business days of the customer's order, but in any case within 15 days of the order date. If the goods are unavailable, the customer will be notified immediately.

(2) The postage/shipping costs are shown for each product in the tsar Shop.

 

payment terms

Unless paid online in advance upon conclusion of the contract, invoices are due immediately upon receipt of the invoice, without deduction or fees, using the payment slip enclosed with the goods. In the event of late payment, the customer is obliged to reimburse tsar-Shop for all reminder and collection costs incurred as a result of this late payment and necessary for appropriate legal action.

 

warranty

The warranty is provided in accordance with the statutory provisions for a period of 24 months from receipt of the goods. If replacement or repair is not possible (impossible, too costly, unreasonable, delay), the buyer is entitled to a price reduction or, if the defect is not minor, to cancellation of the contract (rescission). Compensation for consequential damages (resulting from defects), as well as other property damage, financial losses, and damages to third parties against the customer, is excluded, unless it is a consumer transaction.

 

damages

(1) The tsar shop shall only be liable for damages in cases of intent or gross negligence, with the exception of personal injury. Unless the transaction is a consumer transaction, the injured party must prove that gross negligence has occurred.

(2) Compensation for consequential damages (due to defects) and pure financial losses is excluded in relation to entrepreneurs.

(3) The tsar shop accepts no liability whatsoever for the formal or factual accuracy of the information contained in the publications.

 

data protection

The customer acknowledges that the customer data specified in the contract will be stored and processed for accounting and customer record purposes. The data will be used to comply with legal requirements and to process payments. Customer data will not be disclosed to third parties unless this is absolutely necessary for the execution of the contract. More about the privacy policy here.

 

Place of jurisdiction and applicable law

(1) Austrian substantive law shall apply to this contract, excluding the UN Convention on Contracts for the International Sale of Goods. If the contractual partner is a consumer, the mandatory provisions of the law of the country in which they have their habitual residence shall also apply to this contract. The place of performance of the contract is the registered office of tsar-Shop.

(2) The court with jurisdiction at the registered office of tsar-Shop shall have exclusive jurisdiction over any disputes. If the customer is a consumer within the meaning of the KSchG (Consumer Protection Act), the jurisdiction of the court in whose district the customer's place of residence, habitual abode, or place of employment is located shall apply.
