Scope of application

(1) The following "General Terms and Conditions" (GTC) apply in the version valid on the day of the order for all purchase contracts for services and products between the tsar Gesundheitsbildung KG Shop (in short: tsar-Shop) and its customers. By placing an order, the customer agrees to these GTC and is bound by them.

(2) Should individual provisions of these GTC be invalid in whole or in part due to mandatory statutory provisions, the remaining provisions of these GTC shall remain in full force and effect.

 

Conclusion of contract

The contract is concluded by acceptance of the order by the tsar store, either by sending an order confirmation electronically or by post or directly by dispatching the ordered goods.

 

Right of withdrawal

(1) You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods. To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or e-mail). You can use the attached sample withdrawal form, but this is not mandatory. To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

 

Consequences of revocation

(1) If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. The costs of the return shipment shall be borne by the customer.

(2) We may refuse to refund you until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

(3) There is no right of withdrawal for services that have been transmitted online (e.g. online courses and training courses, documents, vouchers) or for audio or video recordings such as CDs, DVDs etc. or for computer software delivered in a sealed package if the goods have been unsealed after delivery."

Prices

(1) In principle, the purchase price for the ordered goods shall be deemed to have been agreed, which results from the current prices in the online store and similar publications of the tar store. Depending on the status of the customer (member or non-member of tsar Premium), the prices stated in price lists or in the online store shall apply.

(2) Unless otherwise stated, all prices are gross prices including statutory VAT and excluding all expenses incurred in connection with shipping.

 

Terms of delivery

(1) Delivery is normally made within 7 working days of the customer's order, but in any case within 15 days of the order date. If the goods are not available, the customer will be informed immediately.

(2) The postage/shipping costs are shown with the respective product in tsar Shop.

 

Terms of payment

Unless paid in advance online upon conclusion of the contract, invoices are due immediately upon receipt of the invoice by means of the payment slip enclosed with the goods, free of deductions and charges. In the event of default of payment, the customer is obliged to reimburse all reminder and collection expenses incurred by the tsar store as a result of this default of payment that are necessary for appropriate legal action.

 

Warranty

The warranty is provided in accordance with the statutory provisions for a period of 24 months from receipt of the goods. If replacement or improvement is out of the question (not possible, too much effort, unreasonable, delay), the buyer shall be entitled to a price reduction or, if the defect is not minor, rescission of the contract (rescission). Compensation for (consequential) damages, as well as other material damages, financial losses and damages to third parties against the customer, unless it is a consumer transaction, is excluded.

 

Compensation for damages

(1) The tsar store is only liable for damages in the event of intent or gross negligence, with the exception of damages to persons. The existence of gross negligence must be proven by the injured party, unless it is a consumer transaction.

(2) Compensation for (consequential) damages and pure financial losses shall be excluded vis-à-vis entrepreneurs.

(3) The tsar store accepts no liability for the accuracy of the form or content of the information in the publications.

 

Data protection

The customer acknowledges that the use of the customer data specified in the contract will be stored and processed for accounting and customer record purposes. The data will be used to fulfill legal requirements and to process payment transactions. Customer data will not be passed on to third parties unless this is absolutely necessary for the execution of the contract. More about the privacy policy here.

 

Place of jurisdiction and applicable law

(1) This contract shall be governed by Austrian substantive law to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If the contractual partner is a consumer, the mandatory provisions of the law of the country in which he has his habitual residence shall also apply to this contract. The place of performance of the contract is the registered office of the tsar store.

(2) The competent court at the registered office of the tsar store has exclusive jurisdiction for disputes. If the customer is a consumer within the meaning of the KSchG, the jurisdiction of the court in whose district the domicile, habitual residence or place of employment of the customer is located shall be deemed established.
