Scope of Application

(1) The following “General Terms and Conditions” (GTC) apply, in the version in effect on the date of the order, to all sales contracts for services and products between the tsar Gesundheitsbildung KG Shop (hereinafter: tsar-Shop) and its customers. By placing an order, the customer agrees to these GTC and is bound by them.

(2) Should any provision of these Terms and Conditions be wholly or partially invalid due to mandatory statutory provisions, the remaining provisions of these Terms and Conditions shall remain in full force and effect.

 

Conclusion of the Contract

The contract is formed upon acceptance of the order by tsar-Shop, either by sending an order confirmation electronically or by mail, or directly by shipping the ordered goods.

 

Right of Withdrawal

(1) You have the right to cancel this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party designated by you—who is not the carrier—took possession of the goods. To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by mail or an email). You may use the attached sample withdrawal form for this purpose, though its use is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period expires.

 

Consequences of the Revocation

(1) If you withdraw from this contract, we must refund to you all payments we have received from you, including delivery costs (except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery option we offer), without delay and no later than fourteen days from the day we receive notice of your withdrawal from this contract. We will use the same payment method for this refund that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees in connection with this refund. The costs of returning the goods shall be borne by the customer.

(2) We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever comes first.

(3) There is no right of withdrawal for services that have been provided online (e.g., online courses and training programs, documents, gift certificates), for audio or video recordings such as CDs, DVDs, etc., or for computer software delivered in sealed packaging, if the goods have been unsealed after delivery.”

Prices

(1) As a general rule, the purchase price for the ordered goods is deemed to be the price listed in the online store and similar publications of the tar Shop. Depending on the customer’s status (member or non-member of tsar Premium), the prices listed in the price lists or in the online store apply.

(2) Unless otherwise stated, all prices are gross prices, including the applicable sales tax but excluding all shipping costs.

 

Terms of Delivery

(1) Delivery normally takes place within 7 business days of the customer’s order, but in any case within 15 days of the order date. If the merchandise is unavailable, the customer will be notified immediately.

(2) The shipping costs are listed for each product in the tsar Shop.

 

Terms of Payment

Unless paid in advance online at the time the contract is concluded, invoices are due immediately upon receipt, without any deductions or fees, using the payment slip enclosed with the merchandise. In the event of late payment, the customer is obligated to reimburse the tsar-Shop for all reminder and collection fees incurred as a result of such late payment and necessary for appropriate legal action.

 

Warranty

The warranty is provided in accordance with statutory provisions for a period of 24 months from receipt of the goods. If replacement or repair is not feasible (impossible, excessively burdensome, unreasonable, or beyond the time limit), the buyer is entitled to a price reduction or, if the defect is not minor, rescission of the contract (rescission). Compensation for consequential damages (resulting from the defect), as well as other property damage, financial losses, and damages to third parties claimed against the customer—provided that the transaction is not a consumer transaction—is excluded.

 

Damages

(1) The tsar-Shop is liable only for damages resulting from willful misconduct or gross negligence, with the exception of personal injury. Unless the transaction involves a consumer, the injured party must prove that gross negligence occurred.

(2) Claims for compensation for consequential damages (arising from defects) and pure financial losses are excluded with respect to business entities.

(3) tsar-Shop assumes no liability whatsoever for the accuracy—whether in form or content—of the information contained in the publications.

 

Privacy Policy

The customer acknowledges that the customer data specified in the contract will be stored and processed for accounting and customer record-keeping purposes. The data will be used to comply with legal requirements and to process payments. Customer data will not be disclosed to third parties unless absolutely necessary for the performance of the contract. Jurisdiction and Governing Law

(1) This contract is governed by Austrian substantive law, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If the contracting party is a consumer, the mandatory provisions of the law of the country in which the consumer has his or her habitual residence shall also apply to this contract. The place of performance for this contract is the registered office of tsar-Shop.

(2) The court with subject-matter jurisdiction at the registered office of tsar-Shop shall have exclusive jurisdiction over any disputes. If the customer is a consumer within the meaning of the Consumer Protection Act (KSchG), jurisdiction shall lie with the court in whose jurisdiction the customer’s place of residence, habitual residence, or place of employment is located.
